Court Frees 19 Inmates From Detention Without Trial

The Ninth Judicial Circuit Court in Gbarnga, Bong County, has set free 19 inmates based on a motion filed by County Attorney Cornelius Flomo Wennah.

Attorney Wennah, in a communication dated Tuesday, April 22, requested the court to invoke the doctrine of Section 18.1 of the Criminal Procedure Law of Liberia.

The section calls for the release of persons jailed for prolonged periods without trial.

In the communication, the Bong County Attorney admitted that some of the defendants had spent up to 28 months without trial and called for the expeditious disposition of their cases.

He asked the court to grant the motion, as not doing so “will be a violation of the rights of the inmates.”

The communication further indicated that efforts by the Justice Ministry to get witnesses to testify in their cases had proved futile.

In consideration of the motion, Judge Boima Kontoe on Friday, April 25, granted the motion and ordered the release of all 19 defendants from further detention.

They were all brought to court and set free after being warned by Judge Kontoe to stay away from crime.coherence of future planning.
